PLEASE READ THESE TERMS CAREFULLY.
When you use our services, you agree to the following terms below. Before we make arrangements for your flight, hotel, car rental, tour, cruise, or other trips, we require that you read over these terms carefully and that you agree to these terms and conditions when booking.
Destination Magic acts as a sales agent for the airlines, tour operators, cruise lines, hotels, car rental companies, or other service providers named in your itinerary (“Suppliers”). Destination Magic is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules. You are here advised that the suppliers whose names appear in the information supplied to you are those who are actually responsible for providing the travel services you have purchased. You consent to and request the use of those suppliers and agree not to hold Destination Magic responsible should any of these suppliers: 1) fail to provide the travel services you have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes you any injury, damage, delay or inconvenience.
You are responsible for thoroughly checking your booked itinerary as soon as you receive it to verify it’s correct with dates, rates, and traveling party.
Destination Magic assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under Destination Magic’s control. You hereby release Destination Magic from all claims arising out of any problem covered in this paragraph.
Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. You are consenting to those terms and conditions. For all vacation trips, you must have made full payment and a signed payment authorization and consumer disclosure form.
When booking cruises, it is important to review and understand the terms and conditions outlined in the cruise contract. The cruise contract contains important information regarding your rights and obligations as a passenger, including provisions related to cancellations, itinerary changes, and other important details. Please take the time to carefully review the contract provided by your cruise line. By booking your cruise through Destination Magic, you acknowledge and agree to the terms and conditions outlined in the cruise contract.
Destination Magic has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. You further understand and acknowledge that travel to many parts of the world may involve the risk of a variety of hazards to your health and/or safety, including but not limited to disease, crime, terrorism, and warfare. Because each traveler’s risk tolerance is different, Destination Magic is not in a position to advise you whether you should travel to any particular place at any particular time. Rather, to assist you in making an informed decision, you should refer to objective third-party sources of travel information, such as that maintained by the U.S. Department of State (travel.state.gov).

For medical information, Destination Magic recommends contacting the Centers for Disease Control at (877) FYI-TRIP orwww.cdc.gov/travel.
Covid-19 – Due to the COVID-19 pandemic, you acknowledge and fully understand that these travel arrangements may be interrupted or canceled by the associated travel supplier, a government entity, or another third party outside of the Agency’s control for reasons that are unforeseeable at this time. You also understand and acknowledge that travel involves the risk of a variety of hazards to health and/or safety, including but not limited to, injury, illness, disease, epidemics, and death. You expressly understand and agree that you assume all such risks associated with travel, whether or not specified herein. And further, understand and acknowledge that Agency has no control over the associated supplier’s policies which, in addition to applicable law, will solely govern any cancellation, rebooking, and refund related to these travel arrangements.

By traveling during the ongoing COVID-19 pandemic, you acknowledge the contagious nature of COVID-19 and voluntarily assume all risks related to exposure to COVID-19 and release, discharge, and hold harmless Destination Magic, its agents, and representatives of and from any claims arising out of or relating to exposure to COVID-19.
You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release Destination Magic from all claims arising out of any problem covered in this paragraph. You agree that the courts in Manatee County, Florida, will be the exclusive jurisdiction for all claims brought by you or Destination Magic, and you hereby submit to the personal jurisdiction of those courts.
You understand that the Transportation Security Administration (TSA) requires you to carry a government-issued identification card in order to board a flight. You have been advised that the name, date of birth, and gender that appears on the identification card must exactly match the same data that is listed on your airline ticket and in your booking records. You acknowledge that your failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss your flight. You further acknowledge that beginning on May 3, 2023, you must present a driver’s license or another form of identification that complies with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information).
You understand that if traveling internationally, you must have a valid passport and, depending upon your destination and nationality, you may need to obtain one or more visas. Destination Magic is not responsible for the issuance of travel identification such as passports and/or visas and travelers should ensure they have or have been approved for the appropriate documents before purchasing travel.
PASSPORTS: Everyone, including children and infants, MUST have a VALID passport to travel internationally (not Passport Card). Failure to comply will result in denial of boarding, no refund, no exceptions (out of the USA). Destination Magic is NOT responsible for passports in ANY way. Passports are required to be valid for 6 months from your return date. PASSPORT CARDS ARE NOT VALID FOR TRAVEL INTERNATIONALLY VIA AIR!
Note to Client: Passport and visa information may be obtained by contacting the Travel Agent Section of the U.S. State Department at 202.647.5225 or by visiting the State Department’s Web site at travel.state.gov. Non-U.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s Web site at www.cdc.gov
TRAVELING WITH CHILDREN: Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary. Destination Magic is not responsible for the lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler & the traveler’s parents/guardians to provide proper documentation to airport authorities.
TRAVEL DOCUMENTS: Travel documents will be sent to you no later than ten (10) days prior to the departure date. Please read through these documents immediately; misprints, misspellings, incorrect dates, etc. are not the responsibility of Destination Magic Included in your travel documents (if airfare is purchased through Destination Magic) are airline electronic ticket receipts (proof of purchase, not boarding passes or actual tickets). Boarding passes are printed at the time of check-in; online with the airline directly, or at the airport when showing passport & checking in luggage. It is very important that you take your travel documents with you in addition to passports and a major credit card for any baggage fees that may apply.
You agree to review your travel documents for accuracy upon receipt and understand that you may contact Destination Magic if you have any questions. You understand that the airline tickets, air tours, or other products you are purchasing are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You acknowledge that you may be charged additional sums by Destination Magic to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets, or any combination thereof. You hereby consent to any post-purchase price increases and authorize Destination Magic to charge your credit card for such additional amounts.
CANCELLATION: In the event that you need to cancel your reservation, please be aware that the travel agency may impose a cancellation fee of no less than $200 per room. The maximum cancellation fee percentage is 10% of the total trip cost. This fee is in addition to any cancellation fees that may be charged by the hotel, cruise, or other travel suppliers. The exact amount of the cancellation fee will depend on the policies of the specific hotel or supplier, as well as the timing of the cancellation. We strongly recommend that you review the cancellation policies of your hotel, cruise, or supplier before making your reservation, as these policies may differ from those of the travel agency. By making a reservation through our agency, you acknowledge and agree to these cancellation policies, and authorize us to charge any applicable cancellation fees to the credit card on file.
For your protection, we strongly recommend purchasing trip cancellation and travel accident insurance. However, no representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. We also strongly recommend that you use a credit card for your purchase so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.
LIMITATION OF LIABILITY: Destination Magic is not responsible for airline delays, cancellations, or other issues caused by third parties or suppliers, including but not limited to airlines, hotels, cruise lines, theme parks, weather-related issues, acts of God, or any other events beyond our control. Any such issues must be addressed directly with the airline, hotel, cruise line, theme park, or the respective third party. Additionally, Destination Magic is not liable for any acts or omissions of any third party, including but not limited to any third-party travel service providers or suppliers.
